These Terms of Service (“Terms”) govern your access to and use of MKT1 AI, including the MKT1 MCP Server and associated skills, agents, tools, frameworks, templates, and resources (collectively, “MKT1 AI”).
By accessing or using MKT1 AI, you agree to be bound by these Terms.
MKT1 AI is operated by MKT1, LLC (“we,” “us,” “our”).
Access to MKT1 AI is offered as a feature available to eligible paid subscribers of the MKT1 Newsletter and does not constitute a standalone software subscription unless otherwise specified.
MKT1 AI is currently offered as a beta feature available to eligible MKT1 LLC paid newsletter subscribers.
Access is provided at our sole discretion and may be modified, suspended, or discontinued at any time without prior notice. Beta access does not constitute a guarantee of continued availability, and the features, functionality, and scope of MKT1 AI may change at any time.
We may add, modify, or remove features, tools, or functionality of MKT1 AI at any time.
Purchasing or maintaining a paid MKT1 LLC subscription, including an annual subscription, does not guarantee continued access to MKT1 AI. Paid subscription fees, including annual subscription fees, are not refundable if access to MKT1 AI is modified, suspended, or discontinued.
Access to MKT1 AI requires:
You are responsible for maintaining your own third-party subscriptions.
Access to MKT1 AI is personal, non-transferable, and limited to the individual associated with the subscribing account.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
If you believe your account has been compromised or used without authorization, you must notify us promptly.
We may suspend or terminate accounts that appear to be shared, abused, or used in violation of these Terms.
You may use MKT1 AI to apply MKT1 LLC’s marketing frameworks, tools, and resources to:
You may retain and use outputs generated through MKT1 AI for your own internal or client business purposes, including consulting, strategy development, marketing execution, or similar professional work.

You may not use MKT1 AI in a manner that places excessive load on our systems, interferes with the operation of the service, or attempts to bypass technical safeguards.
We reserve the right to implement rate limits, usage controls, monitoring, or technical protections necessary to maintain the reliability and security of MKT1 AI.
We may suspend or terminate accounts that appear to engage in abusive, automated, or extraction-based usage patterns.
All content delivered through MKT1 AI — including but not limited to marketing frameworks, strategic models, evaluation criteria, skill instructions, prompts, templates, and methodologies — is and remains the exclusive intellectual property of MKT1 LLC.
Nothing in these Terms grants you any ownership interest in MKT1 LLC’s intellectual property.
All rights not expressly granted in these Terms are reserved by MKT1 LLC.
Your inputs (such as company information, marketing materials, or strategic data) remain your property.
We claim no ownership of your inputs or the outputs generated for you through MKT1 AI.
MKT1 AI may operate through third-party AI platforms and is subject to the availability, performance, and policies of those platforms.
We are not responsible for any acts or omissions of third-party platform providers, including changes to their services, pricing, terms, functionality, or data handling practices.
Your use of third-party platforms is governed by their respective terms of service and privacy policies.
Your use of MKT1 AI involves the transmission of your inputs to third-party AI platforms for processing.
We use subscriber authentication solely to verify access eligibility.
We collect the following limited data in connection with MKT1 AI:

Email address and subscription status used solely to verify access eligibility.
Usage logs
We log requests made to the MCP Server, including timestamps, skill invocations, and authentication events. These logs are used for troubleshooting, security monitoring, and improving MKT1 AI.
Logs do not include the content of your prompts or AI-generated outputs.
Aggregate analytics
We may collect anonymized, aggregate usage data (such as which tools are most frequently used) to improve MKT1 AI.
We do not sell personal data and do not use your MKT1 AI data for advertising purposes.
MKT1 AI is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of:
We do not warrant that MKT1 AI will be uninterrupted, error-free, secure, or free of harmful components, or that any outputs will be accurate, complete, or suitable for your purposes.
Outputs generated by AI systems may contain inaccuracies or incomplete information. You acknowledge that AI-generated outputs should be reviewed and validated before being relied upon for business decisions.
MKT1 AI provides marketing frameworks and strategic resources only and does not constitute professional business, legal, financial, or tax advice.
You are solely responsible for evaluating and implementing any strategies, recommendations, or outputs.
To the maximum extent permitted by applicable law, MKT1 LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising out of or related to your access to or use of MKT1 AI.
In no event shall the total aggregate liability of MKT1 LLC for all claims arising out of or related to MKT1 AI exceed the amounts you have paid to MKT1 LLC in the twelve (12) months preceding the event giving rise to the claim.
You agree not to access or use MKT1 AI in violation of any applicable export control, trade sanction, or international trade laws.
You represent that you are not located in, or accessing MKT1 AI from, a jurisdiction subject to sanctions that prohibit the use of such services.
We reserve the right to modify these Terms at any time.
Updated Terms may be posted on the MKT1 website or communicated through the MKT1 Newsletter.
Your continued use of MKT1 AI after modifications are made constitutes acceptance of the updated Terms.
We may suspend or terminate your access to MKT1 AI at any time, with or without cause and with or without notice.
Upon termination, your right to access MKT1 AI ceases immediately.
Sections 5, 7, 10, 11, and 14 shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in the State of California.
These Terms constitute the entire agreement between you and MKT1 LLC with respect to MKT1 AI.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
MKT1 LLC may assign its rights and obligations under these Terms without restriction.
We welcome feedback regarding MKT1 AI during the beta period.
Any feedback, suggestions, or ideas you provide may be used by MKT1 LLC without obligation or compensation to you.
MKT1 AI is provided as a beta feature with limited support. We are not able to respond to all support requests. We will prioritize responses to critical issues affecting access or security. Support requests must be submitted via our support form. We will not respond to support requests submitted via Substack comments or Substack DMs.
